Terms of Use

These terms are an agreement between you and Nutri Expert Limited, a company incorporated in the Hong Kong Special Administrative Region (“we”, “us”), covering the FoodAmigo iPhone app and this website. By using FoodAmigo you accept them. If you do not, please do not use the app.

1. What FoodAmigo does

FoodAmigo lets you record what you eat and shows how it adds up against daily targets calculated from the profile you enter. You add a meal in one of three ways: photograph it, choose a photo from your library, or describe it in words. An AI model then estimates the dish and its nutrition.

2. Estimates, and what they are not

Every number FoodAmigo shows for a recognised meal is an estimate produced by an AI model. The model cannot see the oil in the pan, weigh the rice, or know the recipe. Two plates that look the same can differ substantially. You can correct any estimate by hand, and we encourage you to do so when you know better.

FoodAmigo is a general wellness product. It is not a medical device. It does not diagnose, treat, cure or prevent any disease, and nothing in the app is medical, nutritional or dietetic advice. Do not use it to calculate insulin doses, manage a clinical condition, or make any decision that would normally involve a doctor. Consult a qualified professional before changing your diet, particularly if you are pregnant, have a medical condition, or take medication.

Some illustrations inside the app are generated with AI. They depict no real person.

3. Subscriptions, renewal and cancellation

FoodAmigo is offered as an auto-renewable subscription, and some plans may be offered as a one-time purchase. Purchases are made through your Apple account.

• Price and duration are shown on the purchase screen inside the app, in your own currency, before you confirm. We deliberately do not print prices on this page: they vary by country and change over time.
• Payment is charged to your Apple account at confirmation of purchase.
• Renewal is automatic. Your subscription renews for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. The renewal charge is taken within 24 hours before that period ends.
• Cancelling is done in iOS: Settings → your name → Subscriptions → FoodAmigo → Cancel Subscription. Access continues to the end of the period you already paid for. Deleting the app does not cancel anything.
• Free trial, where offered: if you cancel at least 24 hours before it ends, you are not charged. If a subscription is bought during a trial, any unused part of the trial is forfeited.
• Refunds are handled by Apple, not by us, under Apple's Media Services Terms. We cannot issue refunds for App Store purchases.

4. Your account and your data

FoodAmigo has no accounts and no passwords. Your diary lives on your device. That has a consequence worth stating plainly: if you delete the app or lose the device without an Apple backup, the data is gone, and we cannot recover it. How data is handled is set out in our Privacy Policy.

5. What you agree not to do

• Send content that is illegal, or that infringes someone else's rights.
• Attempt to break, overload or bypass the recognition service, its rate limits, or the subscription check.
• Reverse engineer, decompile or resell the app, except where local law gives you that right despite this clause.
• Use the app on someone else's behalf as a clinical or professional tool.

We may suspend access to the recognition service where use is abusive or automated.

6. Availability

Recognition needs an internet connection and depends on a third-party AI provider. Features may change, and the service may be unavailable at times. We do not promise uninterrupted operation, and a daily limit applies to how many meals can be recognised per device.

7. Intellectual property

The app, its design, texts and illustrations belong to Nutri Expert Limited or its licensors. You get a personal, non-exclusive, non-transferable licence to use FoodAmigo on devices you own. What you write and photograph remains yours.

8. Liability

To the fullest extent permitted by law, FoodAmigo is provided “as is”, without warranties of accuracy or fitness for a particular purpose. We are not liable for indirect or consequential loss, or for decisions taken on the basis of an estimate the app produced. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.

Nothing here excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are not affected.

9. Terms required by Apple

Apple requires every app sold through the App Store to state the following, and these terms would be incomplete without them.

• Who this agreement is with. It is between you and Nutri Expert Limited, not with Apple. We alone are responsible for FoodAmigo and its content.
• Licence. You get a non-transferable licence to use FoodAmigo on any Apple device you own or control, as permitted by the App Store Terms of Service.
• Support. Apple has no obligation to provide support or maintenance for FoodAmigo. Support requests go to [email protected].
• Warranty. If FoodAmigo fails to conform to any warranty that applies, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, that refund is Apple's entire warranty obligation, and any further claim is ours to answer.
• Product claims. Any claim about FoodAmigo — that it does not conform, that it breaches a legal requirement, or that it falls foul of consumer-protection law — is directed to us, not to Apple.
• Intellectual property. If a third party claims that FoodAmigo infringes their intellectual property, we, not Apple, are responsible for investigating and resolving that claim.
• Legal compliance. By using FoodAmigo you confirm that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with applicable third-party terms when using FoodAmigo — for example, the terms of your wireless data plan.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Changes to these terms

We may update these terms. The date at the top changes with them, and significant changes are announced in the app. Continuing to use FoodAmigo after a change means you accept the new terms.

11. Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have non-exclusive jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory laws of your own country.
